EB-2 Advanced Degree & Exceptional Ability Immigration

The EB-2 Employment-Based Visa is a second preference immigrant visa category for qualified foreign professionals holding advanced degrees or those with exceptional ability in the sciences, arts, or business. This category offers a pathway to lawful permanent residence (green card) for eligible applicants.

Eligibility Requirements

  1. Advanced Degree Qualification: You must possess either a U.S. master's degree or higher (or foreign equivalent), or a U.S. bachelor's degree (or foreign equivalent) plus at least five years of progressive post-baccalaureate experience in your specialty field.
  2. Exceptional Ability Qualification: Alternatively, you can qualify by demonstrating "exceptional ability" in the sciences, arts, or business, which means a degree of expertise significantly above that ordinarily encountered in your field.
  3. Labor Certification Requirement: Most EB-2 petitions require a PERM Labor Certification approved by the Department of Labor, confirming that no qualified U.S. workers are available for the position.

The EB-2 category typically offers faster processing times than EB-3 due to fewer applicants meeting its higher qualification requirements.

  1. Exceptional Ability Evidence: To qualify based on exceptional ability, you must meet at least three of the following criteria:
    • An official academic record showing a degree or certificate related to your area of exceptional ability
    • Letters documenting at least 10 years of full-time experience in your occupation
    • A license to practice your profession or relevant certification
    • Evidence of commanding a salary demonstrating exceptional ability
    • Membership in professional associations
    • Recognition for achievements from peers, government entities, or professional organizations
  2. National Interest Waiver (NIW): In certain cases, the labor certification and job offer requirements may be waived if it's established that your employment would be in the national interest of the United States.
  3. Family Benefits: Spouses and unmarried children under 21 may obtain derivative green cards as dependents of the primary EB-2 applicant.
  4. Permanent Status: Upon approval, the EB-2 visa leads to lawful permanent resident status (green card), allowing you to live and work in the U.S. indefinitely, with a path to citizenship.
